p\u00ebrgjigjeve brenda afatit t\u00eb parashikuar n\u00eb pik\u00ebn 1, t\u00eb nenit 8, t\u00eb k\u00ebtij ligji.<\/li><li>Bashk\u00ebrendon pun\u00ebn p\u00ebr plot\u00ebsimin e k\u00ebrkesave p\u00ebr informacione brenda afateve dhe sipas m\u00ebnyr\u00ebs s\u00eb parashikuar n\u00eb k\u00ebt\u00eb ligj.<\/li><li>Regjistron k\u00ebrkesat p\u00ebr informacion dhe cakton nj\u00eb num\u00ebr rendor p\u00ebr secil\u00ebn prej tyre.<\/li><li>D\u00ebrgon k\u00ebrkes\u00ebn p\u00ebr informim te nj\u00eb autoritet tjet\u00ebr publik, brenda afateve t\u00eb parashikuara n\u00eb k\u00ebt\u00eb ligj, kur rezulton se autoriteti publik ku \u00ebsht\u00eb depozituar k\u00ebrkesa nuk e zot\u00ebron informacionin e k\u00ebrkuar.<\/li><li>Verifikon rastet p\u00ebr dh\u00ebnien falas t\u00eb informacionit qytetar\u00ebve, sipas parashikimit t\u00eb pik\u00ebs 5, t\u00eb nenit 13, t\u00eb k\u00ebtij ligji.<\/li><li>Kryen njoftimet paraprake, sipas neneve 14 dhe 15, t\u00eb k\u00ebtij ligji, si dhe komunikon me k\u00ebrkuesin, sipas nevoj\u00ebs p\u00ebr trajtimin e k\u00ebrkes\u00ebs p\u00ebr informacion publik.<\/li><\/ol><p><strong><em>Kufizimi i s\u00eb Drejt\u00ebs s\u00eb proporcionale dhe n\u00ebse dh\u00ebnia e informacionit d\u00ebmton interest e m\u00ebposht\u00ebm:<\/p><p>a. t\u00eb drejt\u00ebn p\u00ebr nj\u00eb jet\u00eb private;<\/p><p>b. sekretin shkronjat \u201ca\u201d, \u201cb\u201d, \u201cc\u201d dhe \u201c\u00e7\u201d, t\u00eb k\u00ebsaj pike, nuk zbatohet kur titullari i k\u00ebtyre t\u00eb drejtave ka dh\u00ebn\u00eb vet\u00eb p\u00eblqimin p\u00ebr dh\u00ebnien e informacionit p\u00ebrkat\u00ebs ose kur n\u00eb momentin e dh\u00ebnies s\u00eb informacionit ai \u00ebsht\u00eb konsideruar autoritet publik n\u00eb baz\u00eb t\u00eb parashikimeve t\u00eb k\u00ebtij ligji. Pavar\u00ebsisht nga sa parashikohet n\u00eb k\u00ebt\u00eb pik\u00eb, informacioni i k\u00ebrkuar nuk refuzohet n\u00eb rast se ekziston nj\u00eb interes public m\u00eb I lart\u00eb p\u00ebr dh\u00ebbien e tij.<\/p><ol start=\"2\"><li>E drejta e informimit kufizohet n\u00eb rast se \u00ebsht\u00eb e domosdoshme, proporcionale dhe n\u00ebse dh\u00ebnia e informacionit shkakton nj\u00eb d\u00ebm t\u00eb qart\u00eb dhe t\u00eb r\u00ebnd\u00eb ndaj interesave t\u00eb m\u00ebposht\u00ebm:<br \/>a) sigurin\u00eb komb\u00ebtare, sipas p\u00ebrkufizimit t\u00eb b\u00ebr\u00eb nga legjislacioni p\u00ebr informacionin e klasifikuar;<br \/>b) parandalimin, hetimin dhe ndjekjen e veprave penale;<br \/>c) mbar\u00ebvajtjen e hetimit administrativ n\u00eb kuad\u00ebr t\u00eb nj\u00eb procedimi disiplinor;<br \/>\u00e7) mbar\u00ebvajtjen e procedurave t\u00eb inspektimit dhe auditimit t\u00eb autoriteteve publike;<br \/>d) formulimin e politikave monetare dhe fiskale t\u00eb shtetit;<br \/>dh) barazin\u00eb e pal\u00ebve n\u00eb nj\u00eb proces gjyq\u00ebsor dhe mbar\u00ebvajtjen e procesit gjyq\u00ebsor;<br \/>e) k\u00ebshillimin dhe diskutimin paraprak brenda ose midis autoriteteve publike p\u00ebr zhvillimin e politikave publike;<br \/>\u00eb) mbar\u00ebvajtjen e marr\u00ebdh\u00ebnieve nd\u00ebrko-mb\u00ebtare ose nd\u00ebrqeveritare.<br \/>Pavar\u00ebsisht nga sa parashikohet n\u00eb paragrafin e par\u00eb, t\u00eb pik\u00ebs 2, t\u00eb k\u00ebtij neni, informacioni i k\u00ebrkuar nuk refuzohet n\u00eb rast se ekziston nj\u00eb interes publik m\u00eb i lart\u00eb p\u00ebr dh\u00ebnien e tij. Kufizimi mbi t\u00eb drejt\u00ebn e informimit, p\u00ebr shkak t\u00eb interesit t\u00eb parashikuar n\u00eb pik\u00ebn 2, shkronjat \u201cc\u201d dhe \u201c\u00e7\u201d, t\u00eb k\u00ebtij neni, nuk zbatohet kur hetimi administrativ, n\u00eb kuad\u00ebr t\u00eb nj\u00eb procedimi disiplinor, dhe procedurat e inspektimit e t\u00eb auditimit t\u00eb autoriteteve publike kan\u00eb p\u00ebrfunduar. Kufizimi mbi t\u00eb drejt\u00ebn e informimit, p\u00ebr shkak t\u00eb interesit t\u00eb parashikuar n\u00eb pik\u00ebn 2, shkronjat \u201cd\u201d dhe \u201cdh\u201d, t\u00eb k\u00ebtij neni, nuk zbatohet kur t\u00eb dh\u00ebnat p\u00ebrkat\u00ebse jan\u00eb fakte, analiza t\u00eb fakteve, t\u00eb dh\u00ebna teknike ose t\u00eb dh\u00ebna statistikore. Kufizimi mbi t\u00eb drejt\u00ebn e informimit, p\u00ebr shkak t\u00eb interesit t\u00eb parashikuar n\u00eb pik\u00ebn 2, shkronja \u201ce\u201d, t\u00eb k\u00ebtij neni, nuk zbatohet pasi politikat jan\u00eb b\u00ebr\u00eb publike.<\/li><li>E drejta e informimit kufizohet, n\u00ebse \u00ebsht\u00eb e domosdoshme, proporcionale dhe n\u00eb qoft\u00eb se p\u00ebrhapja e informacionit do t\u00eb shkelte sekretin profesional t\u00eb garantuar nga ligji.<\/li><li>\u00a0E drejta e informimit kufizohet edhe kur, pavar\u00ebsisht nga ndihma e dh\u00ebn\u00eb nga autoriteti publik, k\u00ebrkesa mbetet e paqart\u00eb dhe b\u00ebhet i pamundur identifikimi i informacionit t\u00eb k\u00ebrkuar.<\/li><li>E drejta e informimit nuk refuzohet automatikisht kur informacioni i k\u00ebrkuar gjendet n\u00eb dokumente t\u00eb klasifikuara \u201csekret shtet\u00ebror\u201d. N\u00eb k\u00ebt\u00eb rast, autoriteti publik, t\u00eb cilit i \u00ebsht\u00eb d\u00ebrguar k\u00ebrkesa p\u00ebr informim, fillon menj\u00ebher\u00eb procedur\u00ebn e rishikimit t\u00eb klasifikimit pran\u00eb autoritetit publik q\u00eb ka urdh\u00ebruar klasifikimin, sipas ligjit nr. 8457, dat\u00eb 11.2.1999, \u201cP\u00ebr informacionin e klasifikuar \u201csekret shtet\u00ebror\u201d\u201d, t\u00eb ndryshuar. Autoriteti publik njofton menj\u00ebher\u00eb k\u00ebrkuesin p\u00ebr fillimin e procedur\u00ebs p\u00ebr rishikimin e klasifikimit, sipas ligjit, dhe vendos shtyrjen e afatit p\u00ebr dh\u00ebnien e informacionit brenda 30 dit\u00ebve pune. N\u00eb \u00e7do rast, vendimi p\u00ebr trajtimin ose jo t\u00eb k\u00ebrkes\u00ebs p\u00ebr informim merret dhe arsyetohet n\u00eb baz\u00eb t\u00eb kritereve t\u00eb k\u00ebtij neni.<\/li><li>N\u00ebse kufizimi prek vet\u00ebm nj\u00eb pjes\u00eb t\u00eb informacionit t\u00eb k\u00ebrkuar, pjesa tjet\u00ebr nuk i refuzohet k\u00ebrkuesit. Autoriteti publik tregon qart\u00eb pjes\u00ebt e dokumentacionit p\u00ebrkat\u00ebs q\u00eb jan\u00eb refuzuar, si dhe n\u00eb baz\u00eb t\u00eb cil\u00ebs pik\u00eb t\u00eb k\u00ebtij neni \u00ebsht\u00eb b\u00ebr\u00eb ky refuzim.
